About the event

Unlike other associations, SAPEPAA provides its Board Certified Members with 3 x 3 hour CPD sessions per annum as part of your membership fees.  We do not seek to grow and employ 50 or more staff in head office but remain a nimble non for profit. In this event we will be looking at three important topics that impact your SAPEPAA advisory business:

1. Estoppel

We have all heard on numerous occassions about family provisions laws that apply to an estate after the payment of taxes and the repayment of loans.  What is less well known - but MORE important is the equitable use of promissory estoppel.  In short promissory estoppel is where a person such as a parent makes a promise to another - say a child to hand over a farm or business or part thereof.  They are very expensive actions to run but they are gaining ground. In this session senior SAPEPAA adviser - John Gowing will lead us through his involvement in Reeves v Reeves [2024] NSWSC 134 and how that impacts all clients estate planning.  This is a "must attend" session!

2. Nil Interest loans to children and related party lenders

In this session we will look at the use of nil interest loans made from a discretionary trust, such as a family protection trust to children to acquire property (designed to keep assets from matrimonial property) or to a related party lender for the Protector - the gift-loan back scenario.  We will walk through the case law and Commissioner of Taxation announcements plus review a rulingR submission being sent to the ATO for the benefit of SAPEAA members.

3. The Mindset of a successful SAPEPAA Adviser

We all have been drilled into understanding the mindset of our chosen profession - whether lawyer, financial planner or accountant.  But applying these ingrained mindsets into SAPEPAA advice is restrictive and dare we say it bound for failure.  A Board Certified SAPEPAA adviser needs a completely different set of mind tools, resources and conversation abilities.  In this session we will learn what those are - how to build and harness their growth - how to turn off our other professional mindset and catalyse our SAPEPAA mindset for confidence, success and personal/professional growth.
