Grant will unpack the landmark Caldwell v Caldwell (2025) case, where the Court dismissed a wife’s application to treat family discretionary trust assets as “property” under s 79 of the Family Law Act 1975 (Cth). The trusts—established for lineal descendants with the wife as an excluded beneficiary—were found not to be the husband’s alter ego, instead reflecting four generations of family business wealth.
